WALKERSVILLE BURGESS & COMMISSIONERS TOWN MEETING

July 9, 2003

The meeting of the Walkersville Burgess & Commissioners was called to order on Wednesday, July 9, 2003, at 7:30 p.m. Those in attendance included Burgess Ralph Whitmore, Commissioners Sam Eyler, Joe Magluilo, Don Schildt, Chad Weddle, and Debbie Zimmerman, Public Works Director Bob DePaola, Town Planner Susan Hauver, Public Works Supervisor Dennis Miller, Town Manager Gloria Rollins, Resident Trooper Eric Funk, 7 citizens, and 2 press. The meeting commenced with the Pledge of Allegiance.

  1. MINUTES
  2. Commissioner Debbie Zimmerman made a motion, seconded by Commissioner Joe Magluilo, to approve the regular meeting minutes from the June 25, 2003 meeting. The motion passed by a vote of 5-0.

  3. INTRODUCTION OF ORDINANCE 2003-09 – ZONING AMENDMENT
  4. Susan Hauver reviewed the proposed zoning text amendment submitted by Paul Sill, owner of the former Carroll property. The text amendment would add a definition of a recycling collection point and permit this use in the LI Zoning District. The Planning Commission public hearing will be August 26, 2003 and the Burgess and Commissioners hearing will be on August 27, 2003.

    Commissioner Weddle made a motion, seconded by Commissioner Magluilo, to introduce Ordinance 2003-09. The motion passed by a vote of 5-0.

  5. CITIZENS QUESTIONS AND CONCERNS
  6. Brenda Starkey of Olde Towne Jewelers passed out paperweights with a replica of the Town seal inside. She presented a request to the commissioners asking permission to produce and sell the paperweights as momentos of Walkersville, and donating a portion of the profits from the sale to the Glade Valley Lions Club.

    Commissioner Weddle made a motion, seconded by Commissioner Magluilo, to authorize the use of the Town seal in the paperweights. The motion passed by a vote of 5-0.

    Stacy Crouch Law of 207 Winterbrook Ct. requests the speed limit on Winterbrook Ct. be reduced to 15 MPH. She obtained 54 signatures of Winterbrook residents, which included households with 87 children. Residents on the court signed the petition with 100% participation, includes 28 children. Burgess Whitmore stated that he had driven there to review the problem and noted that he does not approve of the basketball equipment in the street or children playing in the street. Commissioner Magluilo agreed that changing the speed limit is not going to solve the problem; that children using the street for a playground is the problem. The street is for transportation vehicles. Commissioner Eyler stated that he felt the 10MPH reduction in speed would help. Trooper Funk stated that he felt 15MPH was a reasonable speed for Winterbrook Ct.

    Commissioner Zimmerman made a motion, seconded by Commissioner Eyler, to change the speed limit on Winterbrook Court to 15MPH. The motion was defeated by a vote of 2-3, with Commissioners Schildt, Weddle, and Magluilo opposed.

    Brenda Starkey of Deerfield subdivision discussed the road standards and road replacement in Deerfield.

  7. UPDATE ON SPRINT LEASE
  8. Ms. Rollins updated the commissioners on the signing of a revised lease with Sprint for locating their equipment for telecommunications on the Crum Road water tower. Commissioner Magluilo asked for an update on the status of communications with Verizon. Gloria will contact Michael Steele of Center for Municipal Solutions for the status of contact with Verizon.

  9. ADOPTION OF COMPREHENSIVE PLAN
  10. Commissioner Zimmerman made a motion, seconded by Commissioner Eyler, to adopt the Comprehensive Plan. The motion passed by a vote of 4-1, with Commissioner Schildt opposed.

     

  11. ACCOUNTS PAYABLE
  12. Commissioner Magluilo made a motion, seconded by Commissioner Weddle, to pay the attached bills. The motion passed by a vote of 5-0.

  13. COMMISSIONERS CONCERNS
  14. Commissioner Eyler asked about the possibility of Cargill putting up a screen fence around the items in the lot. Susan stated that the Planning Commission will be reviewing the site plan and can require screening.

    Commissioner Weddle inquired about the status of the graffiti at the Exxon station; it has been taken care of by the owners.

     

  15. CITIZENS CONCERNS

Diane Williams of 212 Winterbrook Ct. asked the commissioners what could be done now that the 15MPH motion did not pass. Burgess Whitmore stated that the vote was taken and unless one of the commissioners who had voted against it changed their mind, the matter was settled and he could not change it. Commissioner Weddle stated that the Town code establishes the speed on town streets at 25MPH and any change to that would require an ordinance to change the code. He offered to speak with the citizens after the meeting regarding their next step.

Commissioner Zimmerman made a motion, seconded by Commissioner Magluilo, for a closed personnel meeting. The motion passed by a vote of 3-2, with Commissioners Schildt and Weddle opposed.
