WALKERSVILLE BURGESS & COMMISSIONERS TOWN MEETING
August 10, 2005
The Town meeting of the Walkersville Burgess & Commissioners was called to order on Wednesday, August 10, 2005, at 7:30 p.m. Those in attendance included Burgess Ralph Whitmore, Commissioners Sam Eyler, Joe Magluilo, Donald Schildt, Chad Weddle, and Debbie Zimmerman, Town Manager Gloria Long Rollins, Public Works Director Bob DePaola, Planning and Zoning Administrator Susan Hauver, Public Works Supervisor Dennis Miller, 7 citizens, and 1 press.
The meeting was called to order with the Pledge of Allegiance.
Commissioner Don Schildt made a motion, seconded by Commissioner Chad Weddle, to approve the town meeting minutes of July 13, 2005. The motion passed by a vote of 4-0-1, with Commissioner Zimmerman abstaining.
2. CROP WALK ROUTE
Commissioner Debbie Zimmerman made a motion, seconded by Commissioner Joe Magluilo, to approve the proposed CROP Walk route presented by the Walkersville area Council of Churches. The motion passed by a vote of 5-0.
3. CITIZENS QUESTIONS AND CONCERNS
None
4. LETTER OF SUPPORT FOR SENIOR HOUSING COMMUNITY PROJECT
Commissioners reviewed the letter in support of proposed the Senior Housing Community, which is in preliminary process by Osprey Development. The letter was needed by the developer to support their request to Frederick County for a PILOT project.
Commissioner Chad Weddle made a motion, seconded by Commissioner Sam Eyler, to approve the Letter of Support to be sent to Osprey Development for their presentation and request to Frederick County. The motion passed by a vote of 4-1, with Commissioner Magluilo opposed.
5. WHS MARCHING BAND REQUEST FOR SUPPORT
Ms. Mary Fumara, of 8439 Curiosity Court, presented a request for support for the Walkersville High School Marching Band. Burgess Whitmore and Commissioner Schildt expressed their disappointment that the band has never participated or responded to requests to participate in various town parades or the Memorial Day service.
Commissioner Sam Eyler made a motion, seconded by Commissioner Joe Magluilo, to donate $50 from the Community Donations budget to the WHS Marching Band. The motion passed by a vote of 3-2, with Commissioners Zimmerman and Schildt opposed.
Commissioner Chad Weddle made a motion, seconded by Commissioner Debbie Zimmerman, to appoint David Haller as a regular member of the Board of Appeals and to advertise for the alternate position. The motion passed by a vote of 5-0.
Ms. Rollins reviewed the FEMA approval letter for the Frederick County Hazard Mitigation Plan. The Town of Walkersville participated in the development of the plan and adopted the plan. The plan received a "satisfactory" rating for all required criteria, along with encouragement to constantly review and revise and implement the plan.
Representatives from the ARIA 328 Memorial Foundation, including David Denn of Walkersville and Randy L. Losey, presented their proposal to place a memorial to the May 6, 1981 Apollo/Range Instrumentation Aircraft (ARIA) crash. The design of the Memorial is a compass with a field of memorial bricks. In the center of the design there is a granite pedestal with the names of the 21 crew and passengers lost. The diameter is 329 inches, representative of the tail number of the plane. Encompassing the memorial is a six-foot wide pedestrian walkway. Surrounding the memorial are 21 plantings, each plant representing a crew member or passenger. The compass points West to Wright-Patterson Air Force Base and the National Museum of the Air Force where the ARIA Memorial is located. Several present at the meeting, including Burgess Whitmore and Commissioner Eyler, shared their memories of the day of the crash.
Commissioner Don Schildt made a motion, seconded by Commissioner Joe Magluilo, to approve the ARIA 328 Memorial in Heritage Farm Park. The motion passed by a vote of 5-0.
Prices were received for a precast, double stalled public restroom building, which is an FY2006 Program Open Space project. The Parks Committee approved the Smith-Midland "Outback" model at $36,781. Town staff can perform necessary installation.
Commissioner Chad Weddle made a motion, seconded by Commissioner Debbie Zimmerman, to approve staff recommendation for the Smith-Midland "Outback" for $36,781 for the Creamery Park bathroom. The motion passed by a vote of 5-0.
Commissioner Chad Weddle made a motion, seconded by Commissioner Don Schildt, to extend replacement paving per the current contract on Glade Road as requested by town staff. The motion passed by a vote of 5-0.
Commissioner Debbie Zimmerman made a motion, seconded by Commissioner Sam Eyler, to pay the attached bills. The vote passed by a vote of 5-0.
Commissioner Schildt reviewed information on logistics of instituting a Farmers’ Market provided by the Town of Emmitsburg.
Commissioner Eyler noted that there are several unlicensed vehicles parked around town. If a list is provided to the troopers, the cars can be addressed.
Commissioner Eyler clarified the requirements for installing curb cuts for new road/sidewalk work around town. The water line replacement on Pennsylvania and Fulton Avenues does not require ADA implementation at this time.
Burgess Whitmore informed commissioners that he will be attending the Thursday meeting of the Frederick County commissioners to present the town’s bulk trash pickup proposal, scheduled for September 24.
Burgess Whitmore informed commissioners that it is time to start the paperwork for annexation of the Grossnickle and Nicodemus farms. The Toms farm is not interested at this time.
Commissioner Don Schildt made a motion, seconded by Commissioner Joe Magluilo, to hold a closed legal meeting. The motion passed by a vote of 5-0.
Ms. Hauver informed commissioners of a sinkhole in Sun Meadow. It has appeared in the later phases of the project and will be fixed by Washington Homes. She also noted that the Draft Flood Plain Map has been delivered by FEMA. Staff will review the map for accuracy.
Mr. DePaola notified commissioners of the lightning strike at the water plant discovered on July 14. Damage assessed to date is in excess of $11,000 and all invoices are not yet received. A claim will be submitted to LGIT. Mr. DePaola asked commissioners to approve a stronger surge protection plan for the plant, the clearwell, and the water towers. Crum Electric has provided a proposal for the protection.
Commissioner Don Schildt made a motion, seconded by Commissioner Chad Weddle, to authorize up to $15,000 for surge protection on the water system. The motion passed by a vote of 5-0.
Harold Roderuck commented that people should learn about lawn watering.
Staff will check with Ron Layman regarding the Scout activities at the watershed and the compatibility with hunting seasons.
Commissioner Zimmerman announced that the dedication of Trout Park will be postponed until April 2006 due to the construction mess in Sun Meadow and around the park.
