MINUTES
WALKERSVILLE BURGESS & COMMISSIONERS TOWN MEETING
September 8, 2004
The Town meeting of the Walkersville Burgess & Commissioners was called to order on Wednesday, September 8, 2004, at 7:30 p.m. Those in attendance included Burgess Ralph Whitmore, Commissioners Sam Eyler, Joe Magluilo, Donald Schildt, Chad Weddle, and Debbie Zimmerman, Public Works Director Bob DePaola, Public Works Supervisor Dennis Miller, and Town Manager Gloria Rollins, Zoning Administrator Susan Hauver, 1 citizen, and 2 press.
The meeting was called to order with the rearranging of the flags left to right starting with the American flag, Maryland flag, Frederick County flag, and Walkersville flag, and the Pledge of Allegiance.
Commissioner Debbie Zimmerman made a motion, seconded by Commissioner Sam Eyler, to approve the regular town meeting minutes of August 25, 2004. The motion passed by a vote of 5-0.
2. REVIEW OF TOWN CODE CHAPTER ON PEDDLING AND SOLICITING
A magazine company, Premium USA, applied for a peddler’s permit, which Ms. Rollins could not issue. The company had no county references as required by the Town Code. The applicant stated that the town could not prohibit him from going door to door as that would be hindering interstate commerce. Ms. Rollins forwarded the information to town attorney David Severn for an opinion on the legality of the Town’s Chapter 47. Commissioner Weddle will review the law and check with Maryland Municipal League. He will work on the code until November, at which time we will enlist the help of the town attorney if needed.
3. POLICE MEETING REQUESTED
Burgess and Commissioners asked that a closed meeting be scheduled for Wednesday, October 13 with the barrack commander of the Maryland State Police and Cpl. Butler.
4. PERSONNEL MANUAL UPDATE
Commissioner Weddle will have the manual ready on diskette for Ms. Rollins by the end of the week. It will be forwarded to the town attorney for review and then come back to the commissioners for their approval.
5. APPROVAL OF GIS CONTRACT WITH RK&K
A proposal from RK&K was presented to continue updates and maintenance of the town’s GIS layers. Sun Meadow, Creekside, and parts of Deerfield need to be added to the system.
Commissioner Zimmerman made a motion, seconded by Commissioner Magluilo, to approve the On-Call/Open End GIS contract with RK&K in the amount of $20,000. The motion passed by a vote of 5-0.
6. NOTIFICATION OF HYDRANT FLUSHING SCHEDULE
Public works will begin flushing hydrants throughout the town on Monday, October 4, for approximately 4 weeks. An ad will be placed in the Frederick Post and the Gazette, radio stations will be notified, the website and the town channel will carry the notification.
Commissioners unanimously granted their support to the area local churches for their annual CROP walk. The route will be given to the police.
8. COMMUNITY SEMINARS TO BE HELD
Ms. Rollins presented a proposal from BB&T to hold monthly seminars in the town hall on a variety of financial topics. Each seminar will be about an hour, which includes a time for questions.
Commissioner Eyler made a motion, seconded by Commissioner Magluilo, to allow BB&T to present the community seminars in the town hall. The motion passed by a vote of 4-1, with Commissioner Zimmerman opposed.
9. FREDERICK CITY COMPREHENSIVE PLAN
Commissioner Schildt stated that 12-15 citizens suggesting that the town annex areas in our growth area before the city of Frederick does so had contacted him. Commissioners decided to discuss this again at the next town meeting. Ms. Hauver was directed to have the Planning Commission discuss this and render a position statement at their workshop. Ms. Hauver will check the city’s time line for adoption of their plan.
Commissioner Magluilo made a motion, seconded by Commissioner Eyler, to pay the attached bills. The motion passed by a vote of 5-0.
Commissioner Schildt made a motion, seconded by Commissioner Eyler, to hold a closed police and personnel meeting. The motion passed by a vote of 4-1, with Commissioner Weddle opposed.
12. TEMPORARY AND SEASONAL USES CLARIFICATION
Ms. Hauver clarified that the adoption of the Temporary and Seasonal Uses section of the zoning ordinance does not affect individuals selling produce out of the back of a truck or a stand that is taken down every night. There has been some confusion on the part of applicants for peddlers’ licenses as to the requirements for next year’s produce season.
The meeting was adjourned at about 8:20 p.m.
