WALKERSVILLE BURGESS & COMMISSIONERS TOWN MEETING

October 13, 2004

The Town meeting of the Walkersville Burgess & Commissioners was called to order on Wednesday, October 13, 2004, at 7:30 p.m. Those in attendance included Burgess Ralph Whitmore, Commissioners Joe Magluilo, Donald Schildt, Chad Weddle, and Debbie Zimmerman, Public Works Director Bob DePaola, Town Manager Gloria Rollins, Zoning Administrator Susan Hauver, 4 citizens, and 2 press. Commissioner Eyler was recuperating from knee surgery.

The meeting was called to order with the Pledge of Allegiance.

  1. MINUTES

Commissioner Debbie Zimmerman made a motion, seconded by Commissioner Joe Magluilo, to approve the regular town meeting minutes of September 22, 2004. The motion passed by a vote of 4-0.

2. SPRINT LOCATION ON CRUM TOWER

Ms. Rollins reviewed the recommendation of consultants The Center for Municipal Solutions for approval of the permit for Sprint PCS to co-locate their facilities at the Crum Road water tower. Sprint PCS has met the requirements of the town ordinance in applying for the permit. It is recommended that the town permit them to start their construction with the following conditions: a) $25,000 performance bond must be submitted, b) proof of liability insurance must be submitted, c) documentation/certification of the structural modifications per the plans and specification of the structural engineer must be provided, d) consultant must be notified when construction is ready to begin and for final inspection, e) consultant must be notified when construction complete and ready for final review.

Commissioner Zimmerman made a motion, seconded by Commissioner Schildt, to approve the Sprint PCS permit with the recommended conditions. The motion passed by a vote of 4-0.

 

3. CITIZENS QUESTIONS AND CONCERNS

None

 

4. ORDINANCE 2004-09

Ordinance 2004-09, which was introduced at the September 22 town meeting, was sent to Planning Commission for comments. The ordinance includes two new definitions for the APFO ordinance; one for major subdivision, one for minor subdivision. The ordinance will come back to commissioners at a later meeting.

 

5. SALT BUILDING BIDS FOR ENGINEERING

Mr. DePaola reviewed proposed fees from 3 engineering firms for the development of a site plan for the winter salt building permitting and construction. The 3 proposals are: RK&K $49,919, Fox & Associates $14,500, and Arro Consulting $9,860. Mr. DePaola recommended awarding the work to the low bidder.

Commissioner Weddle made a motion, seconded by Commissioner Magluilo, to award the salt building work to the low bidder Arro Consulting for $9,860. The motion passed by a vote of 4-0.

 

6. ACCOUNTS PAYABLE

Commissioner Weddle made a motion, seconded by Commissioner Magluilo, to pay the attached bills. The motion passed by a vote of 4-0.

 

7. COMMISSIONERS’ CONCERNS

Discussion of Annexation

Commissioner Weddle and Commissioner Schildt expressed their desire to contact all applicable property owners located at the south west end of town to ask for their interest in annexing into the Town of Walkersville. The area, which is included in the Walkersville growth area in the town’s comprehensive plan is now also included in the growth area of Frederick City’s comprehensive plan. All properties north of Rt. 26 to Biggs Ford Road will be contacted to express their interest. Ms. Rollins and Ms. Hauver will develop the letter that will be sent.

Commissioner Schildt thanked the commissioners for their donation of a Heritage Farm Park Barry Richardson print to the organization Kids Chance. The item raised at silent auction $110 for the organization.

Commissioner Zimmerman asked for approval for Glade Elementary to hold their annual 5K race. At that time Ms. Pat Casadonte of Glade PTA presented the request. They asked that town resident troopers place barricades on the race route and monitor the race on November 6. Approval by consensus was granted by the commissioners.

 

Burgess Whitmore noted that there is one renewal option year left on the town’s mowing contract and asked commissioners if they want to renew for one year or go out for bid. Commissioner Zimmerman made a motion, seconded by Commissioner Magluilo, to go out for bid for mowing for next year’s mowing season. The motion passed by a vote of 3-1, with Commissioner Schildt opposed.

Commissioner Magluilo announced his official resignation as the commissioner liaison to the Planning Commission. Commissioner Weddle made a motion, seconded by Commissioner Magluilo, to appoint Commissioner Sam Eyler as liaison to the Planning Commission. The motion passed by a vote of 4-0.

 

9. ANNOUNCEMENTS

October 20, 6:30 p.m. Maryland Department of the Environment will hold an informational hearing on the Application to Appropriate and Use waters of the State by 103-29 Limited Partnership to appropriate an annual average of 15,000 gallons of ground water per day and an average of 87,000 gallons per day during the month of maximum use for farm irrigation.

Tuesday, Nov. 9 is the first open house discussions for the Walkersville Regional Plan, to be held from 5 – 8 p.m. at Glade Elementary.

The meeting was adjourned at about 8:00 p.m.
