WALKERSVILLE BURGESS & COMMISSIONERS SPECIAL TOWN MEETING

November 4, 2009

A Special Town meeting of the Walkersville Burgess & Commissioners was called to order on Wednesday, November 4, 2009, at 7:00 p.m. The meeting was called for the purpose of holding a public hearing on Ordinance 2009-08. Those in attendance included Burgess Ralph Whitmore, Commissioners Sam Eyler, Donald Schildt, and Debbie Zimmerman, Town Manager Gloria Long Rollins, TFC. Ramona George, approximately 16 citizens, and Courtney Pomeroy of the Gazette.

Commissioner Chad Weddle was absent due to another commitment.

The meeting was called to order by Burgess Ralph Whitmore, with the Pledge of Allegiance.

1. PUBLIC HEARING ON ORDINANCE 2009-08

George Rudy, 11 W. Crum Road, reported on his research on the ordinance and the supporting documents, i.e. the settlement agreement. He summarized that the settlement involved 10 defendants, including one non-resident. He divided the amount of the settlement contract price for the property by 10 and stated that it will cost the town $470,000. He noted that 4 out of the 5 commissioners are defendants. He stated that it will cost $2,307 per taxpayer. He claimed there is a conflict of interest for the commissioners to make a decision on this as it affects them and recommended tabling the issue for tonight.

George Evans, 19 Georgetown Road, asked if he could contact Mr. Moxley and request that the Walkersville artifacts that have been found on the property could be given to the town. Burgess Whitmore told him the issue for tonight was a public hearing on Ordinance 2009-08.

Jane Abrecht, 27 Maple Avenue, asked if she could ask the gentleman a question (Mr. Rudy). Burgess Whitmore said the issue tonight is a public hearing and that all comments be directed to the Burgess and Commissioners.

Commissioner Don Schildt made a motion, seconded by Commissioner Russ Winch, to adopt Ordinance 2009-08, to approve a settlement agreement and contract of sale for the purchase of 8939 Woodsboro Pike for the purpose of settling litigation. The motion passed by a vote of 4-0.

 

 

There was no further business so the meeting adjourned at 7:14 p.m.
